Transamericainstitute.org is subject to these Terms of Use. The Institute may at any time revise these Terms of Use by updating the Site. These Terms of Use are subject to change, update and/or revision (collectively "Change") by the Institute at any time, without notice, in its sole discretion. Any such Changes shall be effective immediately. You can view the most recent version of these terms at any time at the Site. Each use by you after any such change is implemented constitutes your acknowledgment and unconditional acceptance of such change. Please consult these Terms of Use regularly.
Use of Permitted Materials on the Site
You may use and distribute the publications, reports, surveys, articles, infographics, PDFs, audio and video content, and statistics displayed by the Institute on the Site with attribution to the Institute (collectively, the “Permitted Materials”).You are prohibited from making any material modifications, changes, or alterations to the Permitted Materials that will change or misrepresent the statistical results or findings of the research featured in the Permitted Materials. No intellectual property rights of any kind or title are transferred to you as a result of your use of the Permitted Materials. You must comply with all applicable statutes, laws, and regulations in connection with your use of the Permitted Materials.
In using or distributing the Permitted Materials, you may not remove or alter, or cause to be removed or altered, any copyright, trademark, trade name, service mark, or any other proprietary notice or legend appearing on any of the Permitted Materials. The Institute retains the discretion and right to prohibit your use, reproduction or distribution of the Permitted Materials if such use, reproduction or distribution violates any of the provisions of these Terms of Use and you agree to cooperate with the Institute in causing any such use or distribution immediately to cease.
Proprietary Content
With the exception of certain stock photos or images, or other third party owned content, including but not limited to photographs and biographical information of Institute personnel, all content included on this Site is and shall continue to be the property of the Institute, unless otherwise stated, and is protected under applicable copyright, patent, trademark and other proprietary rights. Please note that all dynamic materials or content on the Site, including but not limited to interactive tools and search mechanisms (the "Proprietary Content") is proprietary information of the Institute or the party that provided the Proprietary Content to the Institute, and it or the party that provided the Proprietary Content to the Institute retains all right, title, and interest in and to the Proprietary Content. Proprietary Content may not be copied, reproduced, distributed, republished, reverse engineered, amended, modified, uploaded, posted, used in violation of the any law or transmitted in any way without the prior written consent of the Institute, which may be withheld in its sole discretion, except that you may print out a copy of the Proprietary Content solely for your personal use. In doing so, you may not remove or alter, or cause to be removed or altered, any copyright, trademark, trade name, service mark, or any other proprietary notice or legend appearing on any of the Proprietary Content. Any use of the Proprietary Content except as expressly provided in these Terms of Use violates the Institute's intellectual property rights. Under no circumstances will you acquire any ownership rights or other interest in any Permitted Materials or Proprietary Content (collectively, “Site Content”) by or through your use of this Site. All rights not expressly granted to you in these Terms of Use are reserved and retained by the Institute or its licensors. No stock photos or images, or other third party owned content, including but not limited to photographs and biographical information of Institute personnel, may be downloaded, copied or otherwise used without express written permission by the rights holder.

This Site may be hyperlinked to other sites (“Third Party Websites”) which are not maintained by, or related to, the Institute. What Information Is Collected by the Site?
In general, you can visit the Site while remaining anonymous by not providing any Personal Information. Indemnity

The Institute reserves the right to monitor use of this Site to determine compliance with these Terms of Use, as well as the right to remove or refuse any information for any reason. You acknowledge and agree that neither the Institute nor any affiliate or third party that provides Site Content to the Institute shall assume or have any liability for any action or inaction by the Institute or such affiliate or third party with respect to any submission.

Miscellaneous
These Terms of Use will be governed and interpreted pursuant to the laws of the state of Iowa, United States of America, notwithstanding any principles of conflicts of law. You specifically consent to personal jurisdiction in Iowa in connection with any dispute between you and the Institute arising out of these Terms of Use or pertaining to this Site. The parties to these Terms of Use each agree that the exclusive venue for any dispute between the parties arising out of these Terms of Use or pertaining to the subject matter of these Terms of Use will be in the state or federal courts in Cedar Rapids, Iowa. If any part of these Terms of Use is unlawful, void or unenforceable, that part will be deemed severable and will not affect the validity and enforceability of any remaining provisions. The failure of the Institute to exercise or enforce any right or provision of these Terms of Use shall not operate as a waiver of such right or provision. Any waiver of these Terms of Use by the Institute must be in writing and signed by an authorized representative of the Institute. Notwithstanding the foregoing, any additional terms and conditions on this Site will govern the items to which they pertain. Nothing contained in these Terms of Use or your use of the Site shall be construed to constitute either party as a partner, joint venturer, employee or agent of the other party, nor shall either party hold itself out as such.
